Abstract:	作為教科書的中學國文課本節取《史記•張釋之馮唐列傳》中「縣人犯蹕」一段，而成〈張釋之執法〉一課，並以法國大革命時期「法律之前人人平等」的簡略口號解讀之，以契合當代法治教育。這固然讓經典活化重生，但也難以避免「以西釋中」、「以今律古」的弊端。因此，本文回歸《史記》原典，參酌相關篇章，梳理西方近代法治思想的發展，期能從自身文化脈絡，闡發經典的現代意義。
