    Abstract: 歷來董仲舒都被視為漢儒思想的代表,而在學術現代化的過程中備受評議:從社會思潮看,其陽尊陰卑、君尊臣卑、男尊女卑的倫理觀念,以及天志、災異之說,大悖於民主、科學的現代化標竿。從學理內涵看,其氣化宇宙論中心的天人相應之說,不但未有如先秦儒學天人合一的道德形上學高度;在自律道德的提問中,董氏人副天數之說,也未能如孔孟般從心性深遂處肯定自我生命的存在及價值,從而一切倫理規範皆取決於外在權威,淪作無源之水。如果我們願意張開董氏立說的發生脈絡,將其立論言說從對君策論的性質去看,便不難發現董仲舒面對專制君權時「內直而外曲成而上比」的身段:以「天志」高於人間至尊的君王之上;以看似超然客觀的「深察名號」之法,取得與君王平等論理的空間;以性善自覺之「聖人之性」要求君王,以質樸未善之「中民之性」寬容庶眾,以「義」律君,以「仁」待民。這些說法未必周密深遂,不免疏漏弊端;但細察其深意所在,也不能不視作孔孟仁政之說的後續發展之一。
