    Abstract: 本文先由權利的意涵闡釋為切入點,並根據文獻確立教育權的派典與主體,進而釐清教育權、受教權與學習權間之關係,以確立學習權的相關內涵及影響因素。其次循著時間遞嬗的脈絡考察我國編班方式的演進,以探究常態編班方式的優缺點,並論述常態編班政策推動與學生學習權的關係與影響。最後,就保障學生「學習權」的角度提出未來我國國中小落實常態編班政策之配套及建議。
